Agada is not involved in the process of providing any medical advice, medical treatment or conduct medical procedure to its client. Any information provided on the Platform is intended as a guide only and should not be construed as a substitute for any medical service/ advice. The Platform provides the information to the Clients based on the information provided by the Healthcare Facilities that are associated with the Platform. Based on the condition, requirements and treatment plans as may be requested by the Clients, the Platform shall gather the information from the Healthcare facilities in the location and shall share them with the Client. However, the Platform shall not validate any information provided by the Healthcare Facility, nor do we endorse any particular doctor, medical staff or Healthcare Facility. If you wish to avail the services from a Healthcare Facility based on the information provided by the Healthcare Facility through the Platform, you do so at your own risk. All payments for the Services availed from the Healthcare Facility shall be made directly to the Healthcare Facility. Agada shall not be involved in the engagement and payment process of the Healthcare Facility and as we do not control the advice or services provided by the Healthcare Facility, we cannot guarantee or endorse the authenticity, quality, safety or legality of any Healthcare Facility’s service or advice. Therefore, Agada shall not be held liable for any deficiency of services, negligence in any services provided by the Healthcare Facility including but not limited to loss or misuse of Information by the Healthcare Facility, fraud or cheating by the Healthcare Facility etc or any action or omission by the Healthcare Facility that shall cause loss, damage and harm to the Client in any way.
We shall not conduct any screening of the Healthcare Facility and our association with the Healthcare Facility is only limited to the information provided by them and therefore we recommend that you undertake your own research into any Healthcare Facility provided by the Platform before engaging and appointing them for the services. You should also be aware that the information and details provided by the Platform for any Healthcare Facility should not be construed as an endorsement by Agada for any particular Healthcare Facility or constitute ant comparative ranking of the Healthcare Facilities.
All materials on the Platform are copyrighted and highly confidential and are provided solely for the purpose of providing the Service. The Users are not to use the material or information that it has access to in any manner without the prior permission of the owner of such information.
You may not use any means, software’s techniques including data mining techniques or other automated devices or programs to catalog, download or otherwise reproduce, store, analyze or distribute content available on the Platform which shall be detrimental to the Platform and the owner of the Information. Further, you may not use any such automated means to manipulate the Platform or attempt to exceed the limited authorization and access granted to you under these Terms and Conditions. You may not resell use of, or access to, the Platform to any third party.
As super administrators of the Platform, Agada, its employees, and its assignees shall have access and shall be privy to the Information uploaded by you in the Platform. As you are availing services from the Healthcare facility, it is pertinent that your information be shared with the Healthcare Facility and the respective medical professional and staff you have engaged shall also have access and shall use your Information including but not limited to copy, upload and download your Information into their system that you have uploaded in the Platform.

ACCESS AND USE OF INFORMATION OUTSIDE YOUR JURISDICTION:

The Information uploaded and provided by You for the purpose of availing the Services of the Platform, including but not limited to your personal information and documents may be transferred to, processed, maintained, and used on any device, computers, servers, and systems by Healthcare Facilities and third parties located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. You agree and understand that you shall obtain all the details and information as may be required from the Healthcare Facilities prior to engaging the Healthcare Facility. You understand and agree that in the event the Healthcare Facility is providing your services and transferring, processing, maintaining, and using your Personal Information from any location outside your jurisdiction, the applicable laws and the jurisdiction of the said location may apply. In such a scenario, you understand that the laws of the said location of the Healthcare Facility may not provide adequate protection and reliefs which may be granted to you under the laws of your state/ country.

ELIGIBILITY TO USE THE SERVICES

You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

Compliance with Laws. You are responsible for complying with all laws, guidelines and regulations when you access and use the Services. You agree to use the Services only in compliance with these Terms and applicable law, and in a manner that does not violate our legal rights or those of any third party(ies).

CHANGES TO THE TERMS

We may vary or amend or change or update these Terms, from time to time entirely at our own discretion. We will be sending you a notification regarding change in the Terms. You shall be responsible for checking these Terms from time to time and ensure continued compliance with these Terms. Your use of Platform after any such amendment or change in the Terms shall be deemed as your express acceptance to such amended/changed terms and you also agree to be bound by such changed/amended Terms.
